341 Meeting of Creditors Transcripts

The short answer

Early in every bankruptcy case, the debtor answers questions under oath at the meeting of creditors held under Section 341 of the Bankruptcy Code. No judge attends, but the testimony is sworn, it is recorded, and it can matter enormously later: in dischargeability litigation, in fraud investigations, in stay relief fights, and any time a debtor's story changes.

Getting that recording turned into a usable transcript involves a different path than a court hearing, because the meeting is recorded by the trustee rather than the court. We handle 341 transcripts regularly and know the request process.

Why parties order 341 transcripts

Creditors' attorneys order them to pin down what the debtor said under oath about assets, income, and transfers before filing an adversary proceeding. Trustees use them when testimony conflicts with the schedules. Debtors' counsel orders them to prepare for follow-up examinations. In litigation over discharge or fraud, the 341 transcript is often the first sworn account in the record.

Because the testimony is sworn, a certified transcript of a 341 meeting can be used to impeach later testimony that drifts. A clean, certified record of exactly what was said is the whole point.
